Challenger App Terms and Conditions
1. Introduction Welcome to Challenger, an application developed by Pokket Company (referred to as “We”, “Us”, “Our”). By accessing or using the Challenger app, you (“User”, “You”) agree to comply with and be bound by these Terms and Conditions. If you do not agree with any of these terms, please refrain from using our services.
2. Eligibility
2.1 Users must be at least 18 years old to register and use Challenger in Australia.
2.2 By using Challenger, you confirm that you meet this age requirement and have the legal capacity to enter into binding agreements.
2.3 Employees of the Organizer and their immediate families are not eligible to participate.
3. Account Registration
3.1 Users must register an account to access the features of Challenger.
3.2 You are responsible for maintaining the confidentiality of your account information and for all activities that occur under your account.
3.3 Providing false information or impersonating others is strictly prohibited.
4. Use of Pokket Currency
4.1 Challenger uses an internal currency called Pokket for transactions within the app.
4.2 Users can purchase Pokket using Australian dollars (AUD) or earn Pokket through successful challenges.
4.3 Pokket cannot be transferred outside the Challenger app, redeemed for cash, or used for any purposes outside the app. 4.4 The exchange rate is set by Pokket Company, where Pokket is sold at 1.29 AUD and bought at 1 AUD. We reserve the right to adjust this rate as necessary.
5. Challenge Creation and Participation
5.1 Users can create custom challenges, set rules, define entry fees, and determine prizes using Pokket.
5.2 All challenge rules must comply with Australian laws and regulations, including skill-based competition guidelines.
5.3 The maximum prize for any challenge is limited to 1,000 Pokket.
5.4 The maximum entry fee for any challenge is set at 5 Pokket.
5.5 Participants can have a maximum of two retries for each challenge.
5.6 Upon winning, the prize amount is automatically transferred to the winner’s account in Pokket currency.
5.7 By entering, Participants confirm that they meet all eligibility criteria and agree to these Terms and Conditions.
6. Credit Limitations and Withdrawals
6.1 Users cannot have a total balance exceeding 2,000 Pokket in their accounts at any given time.
6.2 The minimum withdrawal amount is set at 20 Pokket, ensuring a reasonable threshold for transferring funds out of the platform.
6.3 Users must purchase a minimum amount of Pokket to be eligible for certain challenges or withdrawals, as specified within the app.
7. Prohibited Content and Activities
7.1 Users are prohibited from creating challenges that promote illegal, violent, or harmful activities.
7.2 Any fraudulent, deceptive, or manipulative behavior is not allowed and may result in account suspension or termination. 7.3 Users must not use Challenger to promote gambling or other activities restricted by Australian law.
8. Fees and Payments
8.1 By purchasing Pokket or paying challenge entry fees, you agree to our pricing, payment terms, and any applicable taxes.
8.2 All transactions within the app are final and non-refundable unless otherwise required by law.
9. Intellectual Property
9.1 All content, features, and functionalities of the Challenger app, including the Pokket currency system, are the property of Pokket Company and are protected by intellectual property laws.
9.2 You are granted a limited, non-exclusive, and revocable license to use Challenger for personal, non-commercial purposes.
10. User-Generated Content
10.1 By creating and participating in challenges, users may submit content to the platform. You retain ownership of this content but grant Pokket Company a worldwide, royalty-free license to use, display, and distribute it within the app.
10.2 You are responsible for the content you submit, ensuring it complies with Australian law and these Terms and Conditions.
11. Limitation of Liability
11.1 Pokket Company is not liable for any indirect, incidental, or consequential damages arising from the use or inability to use Challenger.
11.2 We make no guarantees regarding the accuracy or reliability of user-generated challenges or the outcome of any challenge.
12. Account Suspension and Termination
12.1 Pokket Company reserves the right to suspend or terminate any user account found to be in violation of these Terms and Conditions.
12.2 We may also terminate accounts for fraudulent activities, security breaches, or legal violations.
13. Dispute Resolution
13.1 In the event of a dispute arising from the use of Challenger, we encourage users to contact our support team for resolution.
13.2 If a dispute cannot be resolved amicably, it will be governed by the laws of Australia, and any legal proceedings will take place in the courts of Victoria, Australia.
14. Changes to Terms and Conditions
14.1 We reserve the right to modify these Terms and Conditions at any time.
14.2 Users will be notified of significant changes, and continued use of the Challenger app after changes indicates acceptance of the revised terms.
15 Privacy and Data Protection
15.1 By entering the Competition, Participants consent to the Organizer collecting, storing, and processing personal data as per our Privacy Policy Acceptable.
15.2 Information will be used solely for Competition administration and, if agreed, for marketing purposes.
15.3 In addition to these Terms, our Privacy Policy describe how we process the personal information we may collect when you use the Challenger! Services, and how we protect your privacy.
